The consumer has the right to inform Automaticals Consulting that he cancels the purchase, without payment of a penalty and without giving a reason within 14 days from the day following the delivery of the product. For digital products, such as a license key for the use of a software package, it must be demonstrated that this license key has not yet been activated. If this license key is activated, this right will expire.

Article 1: General provisions
The electronic web shop of Automaticals Consulting, bvba with registered office in Ostend (Belgium), Pareloesterlaan 25, VAT BE 0867.277.295 (hereinafter Automaticals Consulting) offers its customers the opportunity to purchase its products online. These General Terms and Conditions ("Conditions") apply to all items from the range offered on this webshop and to any purchase made by the customer at Automaticals Consulting. The customer accepts that these Terms and Conditions will be the only ones applicable, to the exclusion of his own general or specific (purchase) terms and conditions, even if these would stipulate that they are the only ones applicable.
Article 2: Price
All prices mentioned are always exclusive of VAT and all other taxes to be borne by the customer. If transport, reservation or administrative costs are charged, this will be stated separately. The price statement only refers to the articles as it is described verbatim. The accompanying photo is intended to be decorative and may contain elements and/or items that are not included in the price.
Article 3: Offer
Each offer is only open to customers residing in the European Union. The articles are intended for normal private use only. Despite the fact that the catalogue and website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, or contains material errors, or is not up-to-date. If you have specific questions about, for example, sizes, colour, availability, delivery time or delivery method, please contact our customer service in advance (see article 12). Automaticals Consulting is only bound by an obligation of means as regards the accuracy, timeliness, or completeness of the information provided. Automaticals Consulting is in no way liable in the event of material errors, typesetting or printing errors. The offer is always valid while stocks last and can be adjusted or withdrawn by Automaticals Consulting at any time. Automaticals Consulting is entitled to refuse orders, adjust the delivery times, split the deliveries, or attach other conditions to the delivery without giving reasons.
Article 4: Online purchases
The customer has the opportunity to purchase the items from the Automaticals Consulting range online. The purchase is made when the customer receives a confirmation email from Automaticals Consulting. The customer can choose between the following payment methods: - by credit card
Article 5: Retention of title
The delivered items remain the exclusive property of Automaticals Consulting until the moment of full payment by the customer. However, the risk due to loss or damage passes to the customer from the moment of delivery. The client undertakes to inform third parties, if necessary, of Automaticals Consulting's retention of title, for example to anyone who comes to seize the items that have not yet been fully paid for.
Article 6: Penalties for non-payment
Without prejudice to the exercise of other rights available to Automaticals Consulting, in the event of non-payment or late payment, the client shall owe interest of 10% per annum on the unpaid amount from the date of the breach of contract, ipso jure and without reminder. In addition, the customer is legally and without a reminder liable to pay a lump sum compensation of 10% of the amount in question, with a minimum of 25 euros per invoice. Without prejudice to the foregoing, Automaticals Consulting reserves the right to take back the items that have not been paid for (in full).
Article 7: Complaints
Any visible damage and/or qualitative defect of an article or other defect in delivery must be reported immediately, under penalty of forfeiture of any right.
Article 8: Warranty
a. Legal guarantee (only for consumers)
Under the Act of 21 September 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. Each item is subject to the legal warranty from the date of purchase by (if applicable, delivery to) the first owner. Any commercial guarantee shall leave these rights unaffected.
b. General
To invoke the warranty, the customer must be able to provide proof of purchase. For items purchased online and delivered to the customer's home, the customer must contact Automaticals Consulting customer service in advance, after which the customer must return the item to Automaticals Consulting at his own expense. Any defect must be reported within 1 month of its discovery. Afterwards, any right to repair or replacement expires. The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, abnormal or incorrect use, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, modifications or changes to the article, heavy-handed use, poor maintenance, abnormal or incorrect use. Nor does it apply to articles with a shorter lifespan, or wear and tear articles. Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are not considered to be hidden defects, unless proven otherwise by the Customer. The warranty is not transferable.
Article 9: Renunciation period
The provisions of this article only apply to customers who purchase items online in their capacity as consumers: The consumer has the right to inform Automaticals Consulting that he cancels the purchase, without payment of a penalty and without giving a reason within 14 days from the day following the delivery of the product. Customers who wish to exercise the right of renunciation must contact Automaticals Consulting customer service within 14 days of delivery and return the goods at their expense to Automaticals Consulting, Pareloesterlaan 25, 8400 Ostend, Belgium within 20 days of delivery of the goods. Goods with a sales price of 100 Euro or more must be sent to us by courier (DHL, Fedex, etc.). Only items that are in the original and undamaged packaging, together with all accessories, instructions for use and invoice or proof of purchase can be returned. Will not be taken back under any circumstances: - used, soiled, damaged or incomplete items - items whose packaging (or part of it) has been opened - items that have been custom-made for the customer - items that cannot be returned due to their nature - items that have been specially ordered for the customer.
Article 10: Privacy
Automaticals Consulting undertakes to use your data exclusively for the execution of the agreement concluded by you through your order and to send you information from Automaticals Consulting without obligation. If you also want to receive information by e-mail, please also provide your e-mail address. We treat your data as confidential information and will never pass it on, rent or sell it to third parties. You can request, correct, modify or delete your data that we keep in Automaticals Consulting's customer list at any time and you can refuse to have Automaticals Consulting use your data to send you information. All you have to do is request this in writing to the following address: Automaticals Consulting, Pareloesterlaan 25, 8400 Ostend. The customer is responsible for keeping his log-in details and the use of his password confidential. Your password is stored in encrypted form, so Automaticals Consulting does not have access to your password. Automaticals Consulting strictly respects the Belgian law of 8 December 1992 on the protection of privacy in the processing of personal data. You can access, through your user profile, all the data available about you on Automaticals Consulting for consultation, modification or deletion. The Automaticals Consulting website uses cookies. Cookies consist of a standard internet technology that makes it possible to store and unlock certain information on the user's system. Cookies cannot be used to identify individuals, a cookie can only identify one machine. Every internet user can set his computer in such a way that cookies are not accepted. If your computer does not accept cookies, you may encounter problems during the ordering process. If this is the case, please contact us so that we can still enter your order. Automaticals Consulting keeps online (anonymous) visitor statistics in order to be able to see which pages of the website are visited and to what extent. Article 11: Impairment of validity - non-renunciation
If any provision of these Terms and Conditions is declared invalid, illegal or null and void, this shall in no way affect the validity, legality and applicability of the other provisions. The failure of Automaticals Consulting to enforce any of the rights listed in these Terms at any time, or to exercise any right thereof, shall not be deemed a waiver of such provision and shall not affect the validity of such rights.

Article 13: Changes to the terms and conditions
These Terms and Conditions are supplemented by other terms and conditions that are explicitly referred to, and the general terms and conditions of sale of Automaticals Consulting. In the event of a conflict, these Terms and Conditions shall prevail. Automaticals Consulting may change these Terms at any time without further notice. Any purchase made after the modification constitutes acceptance by the customer of these new Terms and Conditions.
Article 14: Evidence
The customer accepts that electronic communications and backups may serve as evidence.
Article 15: Applicable law - Competent court
Belgian law applies, with the exception of the provisions of private international law on applicable law and with the Rome I Regulation on contracts for the international sale of goods. In the event of any disputes, the courts in Ostend are exclusively competent.
